🏡 Title Tip Tuesday: How You Hold Title Matters

When buying property with your spouse—or anyone else—it’s important to understand how your ownership is legally structured. Two common ways to hold title are Joint Tenants with Rights of Survivorship and Tenants in Common. While they may sound similar, they have very different implications for your future.

🌿 Joint Tenants with Rights of Survivorship (JTWROS)

This option is popular among married couples. It means:

  • Both owners have equal rights to the property.
  • If one owner passes away, the other automatically becomes the sole owner.
  • No need for probate to transfer ownership.

This structure supports seamless transitions and is often chosen for its simplicity and protection of surviving spouses.

🌿 Tenants in Common

This option allows for more flexibility, especially in business or investment partnerships:

  • Ownership shares can be equal or unequal.
  • If one owner passes away, their share goes to their heirs—not automatically to the other owner.
  • Probate may be required to transfer ownership.

This can be a good fit when co-owners want to maintain separate estate plans or financial interests.
