    • The second reading of the annexation of approximately 1.8 acres along Turnersburg Highway and Fourth Crescent Place

Council Member James Pressly recused himself from the Turnersburg Highway rezoning and annexation items because he has an ownership interest in the property.

Regular Agenda

Moose Club Road Rezoning

Council approved the first reading of a conditional rezoning request for approximately 19 acres along Moose Club Road by a 5–3 vote. The proposal would allow a subdivision containing up to 48 single-family homes.

Beauty Street Annexation

The applicant withdrew the related annexation request after the rezoning request was denied.

The Oaks at James Farm Revision

Council unanimously approved the first reading of a zoning amendment for approximately 14.7 acres at the intersection of James Farm Road and Jane Sowers Road. The amendment changes the previously approved plan for 104 townhomes to a proposal for 57 single-family detached homes.

One person spoke during the public hearing. The zoning amendment will be included on the November 2 City Council agenda for a second reading.

Free Nancy Avenue Closure

Council conducted an evidentiary hearing concerning the proposed permanent closure of a portion of Free Nancy Avenue. City Attorney Leah Messick explained that the proceeding is similar to a court hearing and requires Council to make four findings of fact:

    • The closure conforms to state law.
    • The closure is consistent with the City’s Comprehensive Plan, Major Street Plan and other adopted plans and policies.
    • The closure will not restrict access to any property or result in access that is unreasonable, economically prohibitive or reduces property values.
    • The closure will not adversely affect the health, safety or welfare of the community or reduce the quality of public services provided to any property.

Council unanimously approved the closure.

Dover Road Closure

The Dover Road item was removed from the agenda by staff and will be revisited at a later date.
